Terms of Service
The terms for using the Batty app and your online Batty account, including our End User License Agreement.
Last updated October 7, 2026
The Batty app and the BattyApp.com website are owned and operated by Circutus LLC (doing business as Circutus). Batty helps keep track of battery-operated devices and sends reminders when batteries need a check-up. We have written these Terms of Service to be as clear and straightforward as possible, so you know exactly what to expect from us and what we expect from you.
Summary of key points
- One set of terms: These Terms cover the Batty app on your mobile devices (such as phones and tablets) and desktop computers, and your optional online Batty account at BattyApp.com. They also serve as the End User License Agreement (EULA) for the Batty app.
- An account is optional: Batty supports offline use, without an online account. You can create a free online account to back up your data and use Batty on multiple devices.
- You are borrowing, not buying: We grant you a personal license to use the Batty app, but Circutus LLC retains all ownership of the software itself.
- Play by the rules: You cannot copy, modify, sell, or reverse-engineer the app, misuse our online services, or use Batty to share illegal or objectionable content.
- Your content is yours: You own the device records and photos you create, and we handle your personal information according to our Privacy Policy.
- Keep your account safe: You are responsible for keeping your password secure and for activity on your account. You can delete your account at any time.
- We will tell you about changes: If we make significant changes to these Terms, we will notify you before they take effect.
- Our liability is limited: While we strive to provide a flawless experience, Batty is provided “as is,” and our financial liability for damages is strictly capped.
1. About these Terms
Agreement
These Terms of Service (“Terms”) are a legal agreement between you and Circutus LLC (“Circutus,” “we,” “us,” or “our”). By downloading, installing, or using the Batty app, creating a Batty account, or otherwise using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
Definitions
In these Terms:
- “Batty App” means the Batty software application for mobile devices (such as phones and tablets) and desktop computers, including any updates.
- “Batty Account” means the optional online account you register at BattyApp.com, which enables data backup and synchronization with our cloud services.
- “Website” means https://BattyApp.com and its pages, including our account registration and authentication pages.
- “Services” means, together, the Batty App, your Batty Account, the Website, and our cloud services that back up and synchronize your data and deliver reminders and notifications.
- “Your Content” means the content you create or upload using the Services, including records of your battery-operated devices and any photos you take of them.
- “App Store” means the platform from which you obtained the Batty App, such as the Apple App Store or Google Play.
Other terms that apply
Our Privacy Policy at https://BattyApp.com/privacy explains how we collect, use, and protect your personal data, and is part of these Terms. Your use of an App Store is also governed by that App Store’s own terms. If you obtained the Batty App from the Apple App Store, Section 20 also applies to you.
2. Eligibility
To accept these Terms and use the Services, you must be at least the age of majority in your place of residence, or, if you are younger, you must have the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.
You must be at least 13 years old to create a Batty Account. Batty is designed for general audiences and business services, and we do not knowingly collect personal information from children under the age of 13.
If you use the Services on behalf of a business or other organization, you confirm that you are authorized to accept these Terms on its behalf, and “you” includes that organization.
3. Your Batty Account
Creating an account
You can use the Batty App offline without an account. If you choose to create a free Batty Account, you agree to provide accurate information, including a valid email address, and to keep it up to date. We use your email to facilitate password resets and to communicate important service information, including notice of changes to these Terms.
Keeping your account secure
Please choose a strong, unique password for your Batty Account, keep it confidential, and keep your mobile devices and desktop computers secure. Your Batty Account is for your use only, and you may not share your account credentials with others. You are responsible for all activity that occurs under your Batty Account, including any conduct, losses, or damage that result from sharing your account credentials. If you believe your account has been accessed without your permission, please contact us immediately at support@battyapp.com.
Deleting your account
You can delete your Batty Account at any time by following the instructions on https://BattyApp.com/support, or by emailing support@battyapp.com. We will handle, retain, or delete your data in accordance with the timelines described in our Privacy Policy.
Suspended or terminated accounts
If we suspend or terminate your Batty Account as described in Section 16, you may lose access to your Batty Account and to Your Content stored in our cloud services.
4. License to the Batty App
This section is the End User License Agreement for the Batty App.
License grant
Subject to these Terms, Circutus LLC grants you a personal, worldwide, non-exclusive, non-transferable, and revocable license to download, install, and use the Batty App.
Scope of use
This license allows you to use the Batty App for your personal or internal business purposes. You may install the Batty App on a reasonable number of mobile devices and desktop computers that you own or control. If you obtained the Batty App from the Apple App Store, your license is further limited as described in Section 20.
Territory
Because we operate globally, you can generally use the Batty App anywhere in the world. However, this global access is subject to the export control and sanctions laws described in Section 19.
License restrictions
To protect the security, integrity, and performance of the Batty App for all users, you agree that you will not:
- Reverse engineer or decompile: You may not attempt to extract the source code, algorithms, or underlying structure of the Batty App, except to the extent applicable law expressly permits this despite this restriction.
- Redistribute or sell: You cannot rent, lease, lend, sell, or sublicense the Batty App to anyone else.
- Modify or create derivative works: You may not alter the Batty App or build new software based on it.
- Bypass security: You must not circumvent any digital rights management or security features we have put in place.
- Remove notices: You may not remove or alter any copyright, trademark, or other proprietary notices in the Batty App.
5. Acceptable use of the Services
We want Batty to be safe and reliable for everyone. When using the Services, you agree that you will not:
- Access the Services by automated means, such as bots, scrapers, or scripts, other than through the Batty App and the Website as we provide them.
- Interfere with, disrupt, overload, or attempt to gain unauthorized access to the Services, our servers, or other users’ accounts.
- Use the Services to send spam or to harvest personal information about other people.
- Impersonate any person or organization, or misrepresent your affiliation with them.
- Use the Services for any purpose that is unlawful or that violates these Terms.
- Share objectionable content: You agree not to upload, share, transmit, or otherwise distribute any content, including images, that is illegal, objectionable, or harmful. Specifically, you agree that you will not use the Services to distribute:
- Illegal Imagery: Any material that violates applicable laws, including but not limited to child sexual abuse material (CSAM) or content that infringes on third-party intellectual property rights.
- Objectionable Content: Material that is defamatory, obscene, pornographic, harassing, threatening, hateful, discriminatory, or incites violence.
6. Your Content
You own Your Content
You retain full ownership of Your Content. Today, Your Content is private to your own Batty Account, and we do not disclose it to other users. We are developing a feature that will let you choose to share specific devices and photos with other people. If and when you decide to use that feature, the devices and photos you select will be shared only with the people you choose.
License you grant to us
So that we can operate the Services, you grant Circutus LLC a worldwide, limited, non-exclusive, royalty-free, fully paid-up license to host, store, copy, process, and transmit Your Content, solely to provide and support the Services for you, including to back up and synchronize Your Content across your devices and, if you choose to use a sharing feature, to deliver the content you select to the people you choose. This license ends when Your Content is deleted from our cloud services in accordance with our Privacy Policy.
Your responsibility for Your Content
You represent and warrant that you either own Your Content or have obtained the permissions needed to grant the license above, and that our use of Your Content as described in these Terms does not infringe anyone else’s rights. If you stop having these rights or permissions, for any reason, you agree to remove the affected content or notify us so that we can remove it.
Content moderation
Circutus LLC may, but shall not be obligated to, review or monitor Your Content using human, automated, or other moderation and review methods, and may, in its sole discretion, refuse to display or share, remove, or disable Your Content if Circutus LLC determines that it violates these Terms, may harm Circutus LLC or others, or must be removed to comply with applicable codes, laws, legislation, licenses, orders (including court orders), ordinances, rules, regulations, or any other requirement imposed by a government authority.
Reporting objectionable content
If you come across content in the Services that you believe is illegal or objectionable, or that otherwise violates these Terms, please report it to us by email at support@battyapp.com. We will review reports and may remove content, restrict features, or suspend or terminate accounts as described in these Terms. We will also report and cooperate with authorities regarding illegal material, including child sexual abuse material (CSAM), as required by law.
Feedback and suggestions
If you reach out to us with ideas, feature requests, or feedback on how to improve Batty, we greatly appreciate it. However, please know that we may use your feedback to improve our Services without any obligation to compensate you or keep the suggestion confidential.
7. Our intellectual property
Circutus LLC retains all rights, title, and interest in and to the Batty App, the Website, our cloud services, and all related software. This includes all underlying code, user interfaces, designs, trademarks (including the Batty name and logo), and intellectual property rights. Your download of the Batty App or use of the Services does not transfer any ownership rights to you, and all rights not expressly granted in these Terms are reserved by Circutus LLC.
8. Privacy & data
Your privacy is incredibly important to us. Our Privacy Policy at https://BattyApp.com/privacy explains in plain language what personal data we collect, our legal bases for processing it, and your rights regarding your information.
Technical data
To make the Services function, the Batty App and our cloud services collect technical data, such as device information, usage analytics, and technical logs. We use this data to maintain app stability, troubleshoot bugs, and improve the overall user experience, as described in our Privacy Policy.
Usage Data and improvement
Batty is a commercial product, and we want to be upfront about that. You agree that Circutus LLC may combine, de-identify, and analyze data resulting from use of the Services (“Usage Data”)—including which battery-operated devices people own, what kinds of batteries those devices use, and how people manage them over time—to improve Batty and to research, develop, and offer new products and services, some of which we may sell. Usage Data reflects patterns across many users rather than anything that identifies you personally. Any insights, reports, models, or products that Circutus LLC creates from Usage Data belong exclusively to Circutus LLC, even when they contribute to our commercial success.
9. Updates, availability & support
Technology moves fast, and we continuously work to improve Batty.
Updates
We regularly release updates to add new features, fix bugs, and enhance security. The Batty App may automatically download and install updates, depending on your device and App Store settings. If you disable automatic updates, doing so may impact the app’s performance or security, and some Services may stop working with older versions of the Batty App.
Backward compatibility
As we introduce new features, we may occasionally drop support for older operating systems or outdated versions of the Batty App. We do not guarantee that the Batty App will remain backward compatible indefinitely.
Changes to the Services
We may add, change, or remove features of the Services from time to time. If we decide to discontinue the Batty Account cloud services entirely, we will give you reasonable advance notice by email or in the Batty App, so that you can request a copy of Your Content as described in our Privacy Policy.
Support
If you run into trouble, our team is here to help. You can reach our support staff at support@battyapp.com. While we strive to respond promptly, we do not guarantee specific resolution times unless you have a separate premium support contract with us. Circutus LLC is solely responsible for providing any maintenance and support services for the Batty App, as required under applicable law.
10. Fees & paid features
The Batty App and the Batty Account are currently free. In the future, we may offer optional paid features or subscriptions. Before you are charged for anything, we will clearly tell you the price and terms. Purchases made through an App Store are processed by that App Store and are subject to its payment and refund terms.
11. Third-party and open-source components
The Batty App is built using modern development practices, which means it includes certain third-party software and open-source components.
These specific components are licensed to you under their own respective terms and conditions, which take precedence over these Terms strictly regarding your use of those specific components. You can find the attribution list, copyright notices, and specific license terms for these open-source components within the “Settings” page of the Batty App.
12. Warranties & disclaimers
We work hard to make Batty reliable, but software is inherently complex, and we cannot promise perfection.
THE SERVICES ARE PROVIDED TO YOU “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CIRCUTUS LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee that the Services will be entirely free of bugs, uninterrupted, or perfectly secure at all times, that reminders and notifications will always be delivered on time, or that data stored in our cloud services will never be lost.
13. Limitation of liability
TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL CIRCUTUS LLC BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF CIRCUTUS LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY FOR PERSONAL INJURY, OR OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION MAY NOT APPLY TO YOU.
CAP ON DIRECT DAMAGES: In no event shall Circutus LLC’s total liability to you for all direct damages arising out of or related to the Services exceed the total amount you paid to us for the Services during the twelve (12) months immediately preceding the event giving rise to the claim, or fifty US dollars ($50.00), whichever is greater.
14. Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Circutus LLC and its owners, employees, and agents from any third-party claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of Your Content, your misuse of the Services, or your violation of these Terms or of anyone else’s rights.
15. Your legal rights
Nothing in these Terms limits any rights you have under applicable consumer protection or other laws that cannot be waived or limited by contract. If you live in the European Union, the United Kingdom, or another jurisdiction with mandatory consumer protections, those protections continue to apply to you.
16. Termination
These Terms remain in effect until terminated by either you or Circutus LLC.
How you can end these Terms
You can stop using the Services at any time. To end these Terms entirely, delete your Batty Account (if you have one) as described in Section 3, and delete the Batty App from all your devices. Deleting the Batty App alone does not delete your Batty Account.
How we can suspend or end your access
Your license to the Batty App will terminate automatically if you fail to comply with the License Restrictions in Section 4. If you or someone using your Batty Account violates these Terms, or fails to remedy a violation after a warning, Circutus LLC may take action against you, including revoking access to certain or all Services, or suspending or terminating your Batty Account. When appropriate, Circutus LLC will notify you of the action it will take in response to violations of these Terms, but in cases of severe violation, or where required by law, action may be taken without prior notice.
Effect of termination
Upon termination, you must immediately stop using the Services and delete all copies of the Batty App in your possession. Ending these Terms does not automatically delete your account data from our servers. We will handle, retain, or delete your personal data strictly in accordance with the timelines and procedures set out in our Privacy Policy.
17. Changes to these Terms
We may update these Terms from time to time to reflect changes in our Services, business operations, or legal requirements.
If we make significant changes, we will provide fair notice by sending an email to the address associated with your Batty Account or by displaying a prominent banner in the Batty App at least thirty (30) days before the changes take effect, unless a change is required sooner by law or to address a security issue. If you continue to use the Services after the changes take effect, you will be bound by the updated Terms. If you do not agree to the updated Terms, you may stop using the Services and delete your Batty Account before the changes take effect. You can always find the most current version of these Terms at https://BattyApp.com/terms.
18. Disputes & governing law
Informal resolution
If you have a dispute with us, please contact us first at support@battyapp.com and describe the issue. Most concerns can be resolved quickly this way. You and Circutus LLC agree to try in good faith to resolve any dispute informally for at least thirty (30) days before starting a court proceeding.
Governing law and venue
THE INTERPRETATION AND PERFORMANCE OF THESE TERMS SHALL BE GOVERNED BY THE LAWS OF THE STATE OF WASHINGTON, USA, WITHOUT REGARD TO CONFLICTS OF LAWS PROVISIONS. THE PARTIES AGREE THAT PERSONAL JURISDICTION AND VENUE FOR ANY ACTION RELATED TO THESE TERMS SHALL LIE EXCLUSIVELY IN CLARK COUNTY, WASHINGTON, USA, OR IN THE FEDERAL DISTRICT COURT FOR THE WESTERN DISTRICT OF WASHINGTON FOR MATTERS OF EXCLUSIVE FEDERAL SUBJECT MATTER JURISDICTION, AND EACH PARTY HEREBY WAIVES OBJECTIONS TO SUCH JURISDICTION AND VENUE. This does not deprive you of the protection of mandatory laws of the country where you live, as described in Section 15.
19. Export control & U.S. Government end users
Export control and sanctions
The Services are subject to export control and economic sanctions laws. By downloading and using the Batty App or the Services, you represent and warrant that you will comply with all applicable export laws, including the U.S. Export Administration Regulations.
Furthermore, you confirm that you are not located in, under the control of, or a national or resident of any country subject to a comprehensive U.S. government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country, nor are you listed on any U.S. government list of prohibited or restricted parties.
U.S. Government end users
If the Batty App is being acquired on behalf of the United States Government, the software and its documentation are considered “commercial computer software” and “commercial computer software documentation” pursuant to FAR 12.212 and DFARS 227.7202. Accordingly, U.S. Government end users acquire the Batty App with only those rights set forth in these Terms, which apply equally to all other end users.
20. Additional terms for the Apple App Store
If you obtained the Batty App from the Apple App Store, the following terms also apply:
- Agreement with Circutus, not Apple: These Terms are between you and Circutus LLC only, and not with Apple Inc. (“Apple”). Circutus LLC, not Apple, is solely responsible for the Batty App and its content.
- Scope of license: Your license to the Batty App is limited to using it on any Apple-branded products that you own or control, and only as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions.
- Maintenance and support: Circutus LLC is solely responsible for providing any maintenance and support services for the Batty App. Apple has no obligation whatsoever to furnish any maintenance and support services for it.
- Warranty: If the Batty App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) you paid for the Batty App. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Batty App, and Circutus LLC is solely responsible for any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty.
- Product claims: Circutus LLC—not Apple—is responsible for addressing any claims by you or any third party relating to the Batty App or your possession and/or use of it, including but not limited to: (i) product liability claims; (ii) any claim that the Batty App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
- Intellectual property claims: In the event of any third-party claim that the Batty App, or your possession and use of it, infringes that third party’s intellectual property rights, Circutus LLC—not Apple—will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
- Questions and complaints: Any questions, complaints, or claims regarding the Batty App should be directed to Circutus LLC using the contact information in Section 22.
- Third-party terms: You must comply with any applicable third-party terms of agreement when using the Batty App.
- Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary of them.
21. General
Severability
If any part of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that specific part will be severed, and the rest of these Terms will remain in full force and effect.
Assignment
You may not assign or transfer your rights under these Terms to anyone else. Circutus LLC may assign these Terms in connection with a merger, acquisition, or sale of assets, as described in our Privacy Policy.
No waiver
If we do not enforce a provision of these Terms right away, that does not mean we have given up our right to enforce it later.
Survival
The sections of these Terms regarding Your Content (including the license you grant to us, until it ends as described in Section 6), Feedback and Suggestions, Our Intellectual Property, Usage Data and Improvement, Warranties & Disclaimers, Limitation of Liability, Indemnification, Disputes & Governing Law, and this General section will survive even after these Terms are terminated.
Entire agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Circutus LLC regarding your use of the Services, superseding any prior agreements or understandings, including any prior Batty End User License Agreement.
